Hell Just Froze Over After America’s Most Liberal Court Gave Into Trump’s Big Demand



Wow. What a terrific surprise! Before I give you the good news, I want to just point out that hell probably has frozen over at this point. America’s most liberal court – the Ninth Circuit Court of Appeals – is known for their uber-liberal rulings and their very special hatred of President Trump. Many of their rulings are overturned because they are not constitutional or even sane. But even a broken clock is right twice a day and the Ninth Circuit Court of Appeals finally got one right.

Under California law, any person who possesses a legally purchased a magazine capable of holding more than ten rounds of ammunition must either remove the magazine from the state, sell it to a licensed firearm dealer or hand it over to the police. Those citizens who retained their magazines after the law went into effect are risking a fine or up to one year’s imprisonment in county jail. All of that just changed for the better.

Second Amendment activists were overjoyed this week when the Ninth Circuit Court of Appeals backed a lower court’s decision to suspend California’s ban on the possession of large magazines. That’s right… they came down against California and in favor of gun rights. I’m shocked over this. The National Rifle Association has ardently argued that the state’s ban on ownership of magazines holding 10 bullets or more is unconstitutional. Which it is. They won a preliminary injunction by a San Diego district court last year and a three-judge panel on the Ninth Circuit backed that injunction last Tuesday.

The court found that the district court did not abuse its discretion in granting the injunction or by concluding that magazines fall within the scope of the Second Amendment. That’s exactly right… again, I can’t believe they ruled the right way on this one and by doing so gave into a big demand by President Trump that the Second Amendment be recognized here. “The district court did not abuse its discretion by applying the incorrect level of scrutiny,” the judges found. “The district court concluded that a ban on ammunition magazines is not a presumptively lawful regulation and that the prohibition did not have a ‘historical pedigree.'”

Judge John Clifford Wallace dissented from the ruling by stating that evidence provided by the state, including studies and surveys showing the use of large-capacity magazines increase the lethality of gun violence, “was more than sufficient to satisfy intermediate scrutiny.” Aw, there’s the liberal nuttery I expected.

“This is a significant win for law-abiding gun owners in California,” Chris Cox, executive director of the National Rifle Association’s Institute for Legislative Action, said in a statement. “This unconstitutional law criminalizes mere possession of many standard capacity magazines and would instantly turn many law-abiding gun owners into criminals.” Gun owners in California must be breathing a sigh of relief over this one. David French of the National Review opposes the ban and he noted that the Ninth Circuit ruling was limited. It also linked constitutional protection of firearms to potential militia use, which is a development French described as “encouraging.”

According to the NRA, a ruling in the lower courts is expected soon on this. So, the case will almost surely wind up before the Ninth Circuit Court again. The catch this time is that President Trump has nominated Judge Brett Kavanaugh to the Supreme Court, who is a strong advocate for the Second Amendment. The NRA is hopeful that if the case is appealed, “the Supreme Court will likely have a new justice who respects the right to keep and bear arms as protected by the Second Amendment.” In fact, the new leaning of SCOTUS will be in favor of the Second Amendment, so it is likely the NRA will get its wish here.

The California Department of Justice told The San Diego Union-Tribune that it will “continue to vigorously defend the challenged law.” I bet, in fact, I’m sure that Californians will have to fight the powers-that-be in that state should they need to defend their gun rights on this one. California and their version of the DOJ has little respect for the law or the Constitution these days.

“Based in San Francisco, the Ninth Circuit has a reputation for being one of the nation’s most liberal courts. Critics have branded the court the “Nutty 9th” or the “9th Circus,” in part because many of its rulings have been overturned by the U.S. Supreme Court. This includes an infamous 2002 ruling that the Pledge of Allegiance is unconstitutional because of its use of the phrase “under God.”

“Republicans have been working to fill vacancies with conservatives, but suffered a setback this week when the White House withdrew the nomination of Ryan Bounds for the Ninth Circuit after realizing it did not have the necessary support in the Senate. He faced criticism over past college writings.”

As David French said, “The stage may be set for Brett Kavanaugh’s first Second Amendment test as a justice.” And the high court is sure to rule in favor of it. The ruling will protect gun rights and stop illegal confiscation of guns. More from French, “The district court’s 66-page opinion was a legal tour-de-force that not only dismantled California’s justifications for the ban, but also reiterated and reinforced the constitutional and historical basis for the right to keep and bear arms.” This was a great ruling and I am sure President Trump, as well as all Americans who cherish their right to bear arms, will be thrilled with it.

Many have been critical of Google’s plan to launch a censored search engine in China, now a former Facebook executive has called out Google’s CEO for lying about the company’s motives.
Facebook’s former security chief Alex Stamos took to Twitter recently to attack Google CEO Sundar Pichai for his comments defending the company’s decision to move into the China market with its censored search engine known as “Project Dragonfly,” Silicon Beat reports.

In a recent interview with the New York Times, Pichai stated that Google was “committed to serving users in China” and compared Chinese censorship laws to the “right to be forgotten” law in the European Union. Pichai received severe criticism for this comparison, both internally and from those outside of Google.

“Tech companies constantly walk a difficult path between complying with local law and protecting human rights,” Stamos tweeted Thursday. “For Sundar to compare the “right to be forgotten” (which I agree is problematic) with censorship in China is, at best, amoral and mendacious.”

Stamos further added that: “China’s censorship regime is a tool to maintain the absolute control of the party-state and is in no way comparable,” to the right to be forgotten law.

Google software engineer Colin McMillen tweeted: “It is extremely bad that Sundar appears to either think that RTBF is morally equivalent to government surveillance & censorship, or that he appears to think that nobody will notice this analogy is extremely inaccurate.”

The NFL has certainly done its fair share of damage in tarnishing the celebration of our flag, anthem, and military, by protesting during the national anthem. However, with those protests having all but disappeared, it would be good for the NFL to work towards resuming its former place as the primary celebrators of our flag and country, in American sports.

Sunday night was a good start.
