Kavanaugh Hits a Home Run in First Case on Supreme Court, Shows Democrats He’ll NEVER Be Defeated

On Tuesday, Justice Brett Kavanaugh heard oral arguments for the first time at the Supreme Court. Things have calmed down somewhat but it’s hard to tell whether this is a lull in the political storm over his confirmation or if the left is now moving on to others more worthy in their eyes of attack. This is, after all, a political war.

Kavanaugh was calm on the bench and at home. He appeared confident and interacted warmly with the other justices. Banter and lightheartedness were evident during the arguments.

“We wish you a long and happy career in our common calling,” Chief Justice John Roberts told Kavanaugh at the beginning of Tuesday’s arguments, giving the usual welcome he often uses when publicly offering well wishes to colleagues.

His parents, wife, children and former Justice Anthony Kennedy were present for Kavanaugh’s first actions on the high court. Kavanaugh clerked for Kennedy and there is no higher honor for either of them than this confirmation. It is a testament to the teacher and the student and their common legalistic high calling.

“As is tradition, Kavanaugh was seated at the far right of the bench in the seat reserved for the junior justice. Justice Elena Kagan sat one seat to the left. The pair smiled warmly together and laugh throughout, and shook hands at the end of the proceedings. As dean of Harvard Law School, Kagan hired Kavanaugh to teach a course over the winter term.

“Kavanaugh appeared poised and engaged during the arguments, asking almost half a dozen questions of lawyers on each side during both of the day’s cases.

“The scenes at the high court on Saturday and Tuesday were a study in contrasts. The indignant crowds that swelled about the court after the confirmation vote saw one demonstrator standing astride the contemplation of justice statute, while others, given over to desperate rage, attempted to pry open the sealed brass doors at the top of the marble staircase while Kavanaugh took the oaths of office at a private ceremony inside.

“Fear that lingering anger would erupt during Tuesday’s proceedings was palpable, particularly as a court officer delivered the official admonition to remain seated and silent with unusual forcefulness. A smattering of protesters, some of whom wore handmaid costumes, demonstrated in front of the court’s marble plaza in the morning. But as arguments began, a genial and orderly mood prevailed.

“Both cases on Tuesday’s docket concerned the Armed Career Criminal Act (ACCA), a federal law enhancing sentences for repeat offenders that has bedeviled the justices for years. Justice Samuel Alito noted as much in an exchange with a government lawyer during the second argument.

“You’re not exactly on a winning streak here in ACCA cases,” Alito said, drawing laughter from the audience. “You might have gotten a hint that a majority of the Court really hates ACCA and is picking it apart bit by bit by bit.”

“The first case, Stokeling v. U.S., concerns a provision of the ACCA that requires a sentence enhancement for criminals with previous convictions for violent felonies. Stokeling asks whether felony convictions under state law that involve minimal force count for enhancement.

“Alito asked if the ACCA’s definition of “violent felony” reaches shoving, grabbing or pinching. Justice Sonia Sotomayor followed up on this point, turning to her right to pinch Justice Neil Gorsuch, who reacted with good-natured surprise.

“Later in the argument, an attorney for Stokeling mentioned an opinion Roberts wrote in an April case called Sessions v. Dimaya.

“How many votes did that get in Dimaya?” Roberts joked — the opinion referenced was a dissent.”

Meanwhile, you have the likes of Hillary Clinton saying that civility with Republicans is impossible: “That’s why I believe if we are fortunate enough to win back the House and/or the Senate, that’s when civility can start again. But until then, the only thing that the Republicans seem to recognize and respect is strength.”

And then you have the arrogance of Eric Holder who is also inciting violence against the right:

“It is time for us, as Democrats, to be as tough as they are, to be as dedicated as they are, to be as committed as they are,” Holder told a crowd of campaign volunteers and candidates. “Michelle always says — I love her; she and my wife are like, really tight, which always scares me and Barack — but Michelle always says, ‘When they go low, we go high.’ No. When they go low, we kick ’em.”

Even while the Democrats are attacking the Supreme Court and itching for a civil war, it appears the justices are welcoming one another. But the political fight rages on into the midterms. Kavanaugh is showing the country that he is a consummate professional and the Democrats will never cow him or defeat him. He’s on the high court to stay.

Trump came out swinging this morning.

He is angry that Mexico’s government allows these massive groups of immigrants to pass through Mexico and on to our southern border. Trump put Mexico on notice, the gateway pundit wrote:

President Trump issued a blunt warning to Mexico and other Central American nations over their failure to stop illegal migrants and criminal cartels targeting the U.S. southern border, saying he would send the military and shut down the southern border. Trump made his threat in tweet storm Thursday morning in which he said the newly negotiated trade deal with Mexico would take second place to border security.

Over 4,000 migrants are now reported to be in the caravan headed to the U.S.

A horde of thousands migrants from Honduras and other Central American countries on an organized to the U.S. are approaching the Mexican border. Mexico is reportedly sending federal police to stop them.

Over 16,000 illegal alien migrant family units were arrested at the southern border in September.

“I am watching the Democrat Party led (because they want Open Borders and existing weak laws) assault on our country by Guatemala, Honduras and El Salvador, whose leaders are doing little to stop this large flow of people, INCLUDING MANY CRIMINALS, from entering Mexico to U.S…..

….In addition to stopping all payments to these countries, which seem to have almost no control over their population, I must, in the strongest of terms, ask Mexico to stop this onslaught – and if unable to do so I will call up the U.S. Military and CLOSE OUR SOUTHERN BORDER!..

….The assault on our country at our Southern Border, including the Criminal elements and DRUGS pouring in, is far more important to me, as President, than Trade or the USMCA. Hopefully Mexico will stop this onslaught at their Northern Border. All Democrats fault for weak laws!”

Angel Mom Mary Ann Mendoza criticized House Minority Leader Nancy Pelosi for saying that President Donald Trump’s border wall is a “manhood issue” during a Thursday morning interview with Fox News.

Mendoza, whose son died after an intoxicated illegal immigrant ran into his police car, said it was laughable that Pelosi answered a question about the border wall by taking a “jab at our president.”

“Every time Nancy Pelosi opens her mouth it’s just a laugh, because she’s so out of touch with reality that that’s the opportunity she took with a Harvard student to answer a serious national security question … and she took another jab at our president,” Mendoza said.

Pelosi was asked about the wall during a recent Harvard Institute of Politics event and said, “it happens to be like a manhood issue for the president, and I’m not interested in that.”

Mendoza criticized politicians for not taking border security seriously and urged them to “get strong” to prevent illegal immigration.

“We have the right to protect the citizens of this country and if we have elected officials who are not going to work with our president and get the funds necessary to put a wall, because these people will continue finding a way to get over our poor southern border, we have got to get strong and get serious,” Mendoza asserted.
