Migrant Caravan Invading America Just SUED TRUMP & Our Gov’t – Cite Infuriating Claim

The left is busy utilizing lawfare once again to attack President Trump and our government. They are now using it to bolster illegal aliens in the migrant caravan making its way to our southern border. And the premise for it will infuriate you – they are using our own Constitution against us.

The migrants are now suing us claiming we are violating their constitutional rights even though they haven’t set foot on US soil yet. They didn’t think this up… this comes from leftist radical groups and their lawyers.

They are claiming a violation of their due process under the Fifth Amendment which is ridiculous. Fox News has the scoop:

A dozen migrants traveling by foot from Honduras to the U.S. to seek asylum filed a class-action lawsuit Thursday against President Trump, the Department of Homeland Security and others, claiming a violation of their due process under the Fifth Amendment.

The Fifth Amendment states that, “no person… shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law.”

A recent PBS report cited former Supreme Court Justice Antonin Scalia, who ruled in 1993 case that “it is well established that the Fifth Amendment entitles aliens to due process of law in a deportation proceeding.”

Twelve Honduran nationals, including six children, are listed as plaintiffs in the lawsuit. The suit, which was filed Thursday in the U.S. District Court in Washington, D.C., said it is widely known that Guatemala, Honduras and El Salvador are “undergoing a well-documented human rights crisis.” The lawsuit also claims that the plaintiffs’ right to the Administrative Procedures Act and the Declaratory Judgement Act were being infringed upon.

The Central American migrant caravan now numbers approximately 4,000 people, down from a high of 7,200.

The lawsuit points to Trump’s claim that he will prevent the caravan from entering the U.S. It claims that the president cannot stop asylum-seekers by employing the military — when they have a fair claim. The suit criticized the president’s alleged attempt at stoking “fear and hysteria” by claiming that criminals and gang members have joined the caravan.

The suit cited a Trump interview with Fox News’ Laura Ingraham, where the president laid out plans to build tent cities to house migrants. The suit questioned the functionality of such a project, and asked if these living quarters would qualify under the Flores Agreement of 1997. The agreement protects asylum-seekers’ rights and limits how long minors can be held.

Earlier this summer, a federal judge in California rejected a request by the administration to modify Flores to allow for longer family detention. Administration officials say they have the authority to terminate the agreement, but that is likely to be tested in court.

The White House, Department of Justice and the Department of Homeland Security — which were all named as defendants — did not immediately respond to Fox News’ request for comment.

Trump announced in a lengthy speech at the White House on Thursday afternoon that in response to what he called the “crisis at our southern border” and a surge of fraudulent asylum claims in recent years, his administration will soon require asylum-seekers to “lawfully present themselves” at a port of entry.

Asylum claims made by migrants caught crossing the border illegally would seemingly be summarily denied under Trump’s proposal.

The asylum clause of the Immigration and Nationality Act says that anyone who arrives to the U.S. may apply for asylum based on a well-founded fear of persecution, and Trump’s decision was expected to prompt immediate federal court challenges.

Nexus Services Inc. is funding the lawsuits through a civil rights law firm called Nexus Derechos Humanos (Human Rights) Attorneys Inc.

“Federal law enables migrants to apply for asylum in the United States. President Trump and his administration have used ‘increased enforcement,’ like separating families and lengthening detention to violate migrant rights,” Mike Donovan, president of Nexus Services, said in the release.

There is another legal issue at stake, according to the lawsuit. The U.S. cannot send troops into Mexico to cut off the caravan from crossing the border, it said. Even with the National Guard at the border, once an immigrant indicates an intention to apply for asylum, the suit maintained the process has begun.

Immigrants who are seeking asylum must be referred for a “credible fear interview,” for which an asylum officer would determine if the immigrant has a “credible fear of persecution,” the lawsuit said. If the officer makes that determination, then there is a significant chance for the asylum-seeker to be granted asylum, according to the suit.

Trump Gives Adam Schiff New Nickname And He Is Fuming

President Donald Trump has now given Democrat California Rep. Adam Schiff his own nickname.

In a tweet on Sunday the president referred to the congressman, who has been a thorn in his side, as “Little Adam Schitt.”

Go ahead. Say it aloud.

The tweet came after Rep. Schiff appeared on ABC’s “This Week” and said that Democrats would challenge the president’s appointment of Matthew Whitaker as the interim attorney general, The Hill reported.

Rep. Adam Schiff (D-Calif), the likely next chairman of the House Intelligence Committee, said Sunday that Democrats will challenge the appointment of new acting Attorney General Matthew Whitaker.

“Yes and yes,” Schiff told ABC’s “This Week” when asked if Democrats would push back against Whitaker’s appointment and if he is still concerned that he poses a threat to special counsel Robert Mueller’s investigation into Russian election meddling and alleged collusion between Trump’s 2016 campaign and Moscow.

“I think the appointment is unconstitutional,” Schiff said, adding that Whitaker’s appointment has to be subject to Senate confirmation.

“But it’s also in conflict with a more specific statute,” he said. “There’s a succession statute for the Justice Department, which makes it different from other departments.”

Schiff said that succession statute cannot be preempted by presidential appointment.

“So it’s a flawed appointment, but the biggest flaw from my point of view is that he was chosen for the purpose of interfering with the Mueller investigation,” Schiff said, echoing claims of other Democrats.

Last year, Whitaker criticized the Mueller probe and explained how it could be undercut by strategies such as limiting its funding.

Reports indicate that Mueller is very close to filing his final report from his investigation.

Schiff warned on Sunday that Democrats will be keeping a very close eye on Whitaker.

“He needs to know that if he takes any action to curb what Mr. Mueller does, we’ll find out about it. We’ll expose it,” Schiff said.

Schiff did not take kindly to his new name.

Muslim Willing to Sacrifice ‘Millions’ of Lives To Retake ‘Palestine’

“Palestine” must be retaken by Muslims even if it costs “millions” of lives.

That’s the opinion of an imam in Florida whose recent sermon on the topic was uncovered by the Middle East Media Research Institute.

The Oct. 12, 2018, message was from Hasan Sabri of the Islamic Center of South Florida in Pompano Beach.

He said a “believing Muslim’s” position is that Palestine is “Islamic waqf land that was occupied by force” – and that it should be liberated “even if this leads to the martyrdom of tens of millions of Muslims.”

MEMRI reported Sabri also said, “Allah wants each and every one of you to be a man with a cause … for which he lives and dies,” noting that the Palestinian cause “is being plotted against” with “the Deal of the Century.”

The research organization explained, “According to Pompano Beach elected officials, Sabri has recited invocations annually at Pompano Beach city meetings since 2005, and the ICOSF has had a peaceful, 25-year presence in the city, even serving as a polling station. In September 2017, Imam Sabri was a panelist at ‘Interfaith and Race Relations Peace and Acceptance Conference’ at Palm Beach State College in Lake Worth, Florida.”

But the building that is listed as the address of the ICOSF is owned by the North American Islamic Trust, which was named an unindicted co-conspirator in the largest terrorist financing case in America history. The case, U.S. v. Holy Land Foundation, resulted in convictions and imprisonment of several U.S.-based Hamas leaders.

Sabri said: “Take the Palestinian cause, for example. It is now being plotted against with a deal they call the ‘Deal of the Century.’ Why do they call it a ‘deal?’ Because whoever is involved in this treason is not a man of principles. These are peddlers, not men with a cause. All they want are positions and jobs. That is why for them, the cause is nothing but a deal, a matter of give and take. For them, it is nothing but a deal.”

He continued: “But what is the position of a believing Muslim about the Palestinian cause? That Palestine in its entirety is Islamic land, and there is no difference between what was occupied in 1948 and 1967. There is no difference between this village or that village, this city or that city. All of it is Islamic waqf land that was occupied by force. The responsibility for it lies with the entire Islamic nation, and the [Palestinians] should benefit from this land. If a land is occupied or plundered, it should be liberated from the occupiers and plunderers, even if this leads to the martyrdom of tens of millions of Muslims.”

He added, “This is the ruling, and there is no room for discussion or concessions.”

He also said: “[Atheists] always belong to minorities – national minorities, religious sects or minorities, and they have an agenda of destroying this Islamic nation, so they adopt atheism, not because it makes sense, but because it serves their approach. That is why you find most of these people, like I said, calling for goals that are opposite from the general goals of this nation. Our goal is to unite people, to unite Muslims. Their goal is to fragment Muslims even more. Wherever there is an opportunity to split a Muslim country into two, or three, or 10 parts, you will find that they are for it. What does that have to do with atheism? It has to do with an agenda. That’s all.”
