Obama-Appointed Judge Immediately Removed From All Cases Including 2 Very High Profile



After weeks of leftists and mainstream media propagators breathlessly lamenting the “extraordinary bias” of U.S. District Court Judge T.S. Ellis III in the Paul Manafort trial, it seems one of Obama’s own judicial appointees has been discovered to have a significant issue with understanding just exactly what constitutes ethical conduct under the law.

Judge Colin Stirling Bruce of the Central District of Illinois has been removed from presiding over all criminal cases. His recusal came about after a massive ethical breach was revealed. Bruce exchanged emails with an employee at the U.S. attorney’s office in which he commented on, joked about one of his trials in progress at the time, and even criticized the trial strategy being pursued by the United States attorneys in an international kidnapping case.

As the Associated Press reports, “a federal judge in two of Illinois’ highest profile cases has been removed from hearing all his criminal cases after it was revealed he exchanged emails with an employee at the U.S. attorney’s office in which he commented on and joked about one of his trials in progress at the time.”

“Some legal experts said Tuesday the matter could lead to a review of hundreds of cases to see if Judge Colin Bruce had sent out similarly inappropriate emails during trials before, a review process that could create trial delays and logjams at the U.S. District for Court for central Illinois.”

“‘It is an understatement to say that this is outrageous,’ said Phil Turner, a defense attorney in Chicago and a former federal prosecutor in northern Illinois with no cases before Bruce. ‘It’s extremely unusual and way beyond the pale.’”

Judge Bruce has been scheduled to preside over two of the highest-profile federal cases in the state of Illinois:  the case against ex-U.S. Rep. Aaron Schock for corruption case and the case of Brendt Christensen, accused in the 2017 kidnapping and slaying of Yingying Zhang, a Chinese scholar at the University of Illinois.  Neither case has yet gone to trial.

In addition to being recused from all current and pending cases, there could also be a review of hundreds of cases to see if Judge Colin Bruce had sent out similarly inappropriate emails or other additional inappropriate communications during ongoing litigation at any time prior.

At the time of his judicial appointment in 2013, the Obama White House stated in the official announcement of Bruce’s credentials –

“Colin Stirling Bruce currently serves as the First Assistant United States Attorney in the Central District of Illinois, a position he has held since 2010.  In that position, Bruce oversees the day-to-day operations of the office and helps supervise all federal criminal investigations, prosecutions, and appeals taking place within the Central District.  Bruce joined the United States Attorney’s Office in 1989 and has spent his entire 24-year legal career serving as an Assistant United States Attorney.  During that time, Bruce has prosecuted a broad range of federal criminal cases, including large drug conspiracies, complex frauds, and computer-related investigations, and has also handled civil matters on behalf of the United States.  He received his J.D. from the University of Illinois College of Law in 1989 and his B.A. from the University of Illinois at Urbana-Champaign in 1986.”

He was confirmed on October 7, 2013, by a unanimous Senate vote.

It is important to note that legal professionals such as attorneys or judges are  governed by a specialized set of laws and regulations, starting with the rules of legal ethics. Simply put, legal ethics are defined as the minimum standards of appropriate conduct within the legal profession. It is the behavioral norms and morals which govern judges and lawyers. It involves duties that the members owe one another, their clients, and the courts.

As the presiding judge in an ongoing case that has yet to go to trial and choosing to communicate details about the case with the U.S. attorney’s office – who is essentially the chief prosecutor for the United States in criminal law cases, what Bruce effectively did was known as ex parte communication.

Ex parte means one-sided. An ex parte communication is any communication between a judge or juror and a party to a legal proceeding or any other person about the case, outside of the presence of the opposing party or the opposing party’s attorney. This is considered a significant ethical violation as it gives the appearance of partiality, whether it is or not.

As was noted by Thomas Lifeson in American Thinker – Apparently, Judge Bruce’s sense of “collegiality” overwhelmed his common sense and allowed him to make ex parte communications so outrageous as to require this extreme move.  However, note that so far, the removal of Judge Bruce is being termed as “temporary”:

Chief U.S. District Court Judge James Shadid said in a one-sentence statement Tuesday that he had “temporarily reassigned” all of Bruce’s cases in which federal prosecutors are a party.  He didn’t say why.

Lifeson also notes that the reputations of the Department of Justice and federal courts have taken a big hit recently, stating “the fact that the conviction rate percentages in federal courts have risen from the mid-seventies to the nineties since the 1970s could indicate a rise in the quality of federal prosecutors and their work, but it might also be that the sort of “collegiality” that verges into bias is at work.  I wonder if the rate of nomination from assistant U.S. attorneys (the career prosecutors, not the politically appointed U.S. attorneys themselves) has risen in tandem with the rise on conviction rates.”

Many have been critical of Google’s plan to launch a censored search engine in China, now a former Facebook executive has called out Google’s CEO for lying about the company’s motives.
Facebook’s former security chief Alex Stamos took to Twitter recently to attack Google CEO Sundar Pichai for his comments defending the company’s decision to move into the China market with its censored search engine known as “Project Dragonfly,” Silicon Beat reports.

In a recent interview with the New York Times, Pichai stated that Google was “committed to serving users in China” and compared Chinese censorship laws to the “right to be forgotten” law in the European Union. Pichai received severe criticism for this comparison, both internally and from those outside of Google.

“Tech companies constantly walk a difficult path between complying with local law and protecting human rights,” Stamos tweeted Thursday. “For Sundar to compare the “right to be forgotten” (which I agree is problematic) with censorship in China is, at best, amoral and mendacious.”

Stamos further added that: “China’s censorship regime is a tool to maintain the absolute control of the party-state and is in no way comparable,” to the right to be forgotten law.

Google software engineer Colin McMillen tweeted: “It is extremely bad that Sundar appears to either think that RTBF is morally equivalent to government surveillance & censorship, or that he appears to think that nobody will notice this analogy is extremely inaccurate.”

The second half saw a burst of scoring from both teams and, a salute to our veterans from the entire Eagles offense:

The NFL has certainly done its fair share of damage in tarnishing the celebration of our flag, anthem, and military, by protesting during the national anthem. However, with those protests having all but disappeared, it would be good for the NFL to work towards resuming its former place as the primary celebrators of our flag and country, in American sports.

Sunday night was a good start.
